HIRER'S RESPONSIBILITIES

The Hirer is responsible for the Equipment from the commencement of the hire period until it is returned to and accepted by Floris Excavator Hire.

The Hirer must:

• Operate the Equipment safely, responsibly, and in accordance with all applicable New Zealand laws, regulations, and the manufacturer's operating instructions.
• Ensure all operators are 21+ years of age (unless approved in writing by Floris Excavator Hire), competent, suitably trained, and legally permitted to operate the Equipment.
• Use the Equipment only for its intended purpose and within its operating limits.

Before operating the Equipment, the Hirer must:

• Check the engine oil, hydraulic oil, coolant and fuel levels.
• Inspect the Equipment for visible damage, leaks, loose components and excessive track wear.
• Ensure all controls and safety devices are functioning correctly.
• Grease all grease nipples if provided a grease gun.
• Immediately report any faults or damage to Floris Excavator Hire.

The Hirer must:

• Take reasonable care of the Equipment at all times.
• Keep the Equipment secure when not in use and take reasonable steps to prevent theft, loss or vandalism.
• Keep the Equipment reasonably clean during the hire period.
• Return the Equipment in substantially the same condition as received, allowing for fair wear and tear.
• Ensure all buckets, attachments, keys and accessories supplied with the Equipment are returned.

Before excavation, the Hirer must:

• Inspect the work site and ensure it is suitable for safe operation.
• Identify underground services, including electricity, gas, water, sewer, stormwater, telecommunications and fibre.
• Obtain any permits, approvals or consents required for the work being undertaken.

The Hirer must:

• Use only the correct fuel (Diesel) and approved fluids.
• Return the Equipment with the same fuel level as supplied, unless otherwise agreed.
• Stop operating the Equipment immediately if warning lights, alarms, leaks or abnormal noises occur and notify Floris Excavator Hire as soon as practicable.

The Hirer must notify Floris Excavator Hire as soon as reasonably possible if the Equipment:

• Is damaged.
• Breaks down or develops a mechanical fault.
• Is involved in an accident.
• Is lost or stolen.

The Hirer must not continue operating the Equipment if doing so could reasonably cause further damage or create a safety risk.

Where the Hirer transports the Equipment, the Hirer must:

• Use a vehicle legally capable of towing the Equipment.
• Properly secure the Equipment in accordance with New Zealand transport requirements.
• Comply with all applicable road transport laws.

The Hirer must not:

• Operate the Equipment while impaired by alcohol, drugs or any substance that affects their ability to operate safely.
• Use the Equipment for any unlawful purpose.
• Sub-hire, lend or allow any unauthorised person to operate the Equipment.
• Modify, tamper with or remove any safety devices or identification labels.
• Operate the Equipment outside the agreed hire area without Floris Excavator Hire's prior approval.
• Lift or carry people using the Equipment or attachments.
• Use the Equipment in a manner likely to cause unnecessary damage or excessive wear.

At the end of the hire period, the Hirer must:

• Return the Equipment by the agreed return date and time.
• Ensure the Equipment is reasonably clean.
• Ensure the excavator is full of fuel.
• Remove all personal belongings.
• Advise Floris Excavator Hire of any damage, faults or incidents that occurred during the hire period.
